Renunciation of citizenship

An application for consent to renunciation of the Polish citizenship contains:

  1. the applicant’s statement on renunciation of the Polish citizenship;
  2. data of the applicant;
  3. place of residence;
  4. data of the applicant’s spouse;
  5. information about the last place of residence in the Republic of Poland if the applicant resides outside its territory.

A Polish citizen who has parental authority over a minor provides also the following information:

  1. data of the minor;
  2. information whether and before which institution a statement of consent to renunciation of the Polish citizenship was given.

The following documents are submitted with the application:

  1. documents confirming the data and information contained in the application,
  2. a document confirming citizenship of another country or a pledge that it will be granted;
  3. photographs of the people concerned.

An application for consent to renunciation of the Polish citizenship is filed on the application form.

An application for consent to renunciation of the Polish citizenship is submitted personally or by mail with an officially certified signature, via a provincial governor or a consul. If the application does not comply with the requirements specified by law or if the required documents have not been enclosed, an institution to which the application has been submitted requests the applicant to rectify these defects within 30 days from the day the request is received with a warning that failure to rectify these defects shall result in leaving the application not considered. The provincial governor and the consul hand over the application for consent to renunciation of the Polish citizenship with the required documents to the President of the Republic of Poland via the minister competent for internal affairs, without delay. Before handing over the application to the President of the Republic of Poland, the minister competent for internal affairs makes a request to the Commander in Chief of the Police, the Head of the Internal Security Agency, or to other institutions, if necessary, for information which may prove significant in the proceedings for consent to renunciation of the Polish citizenship, and prepares an opinion on the application. The provincial governor, the consul and the minister competent for internal affairs hand over an application for consent to renunciation of the Polish citizenship directly to the President of the Republic of Poland whenever the President decides so, irrespective of the stage of the proceedings. The provincial governor and the consul inform the minister competent for internal affairs that the application for consent to renunciation of the Polish citizenship has been handed over to the President of the Republic of Poland.

The President of the Republic of Poland grants or refuses consent to renunciation of the Polish citizenship in the form of a decision. The Polish citizenship is revoked after 30 days from the date of issuing the decision by the President of the Republic of Poland. The Polish citizenship can also be revoked earlier than within the specified deadline of 30 days. The Chief of the Chancellery of the President of the Republic of Poland submits a copy of the decision to the minister competent for internal affairs. The Chief of the Chancellery of the President of the Republic of Poland prepares announcements about decisions issued in the proceedings for consent to renunciation of the Polish citizenship. Such an announcement contains:

  1. information about the content of a decision issued by the President of the Republic of Poland, date of its issue and number;
  2. 2data of the person concerned:
    1. first name(s) and surname,
    2. date and place of birth,
    3. father’s and mother’s first names;
  3. name of the institution which prepared the announcement and date.
