Evidence obligations of an administrative body in matters of Polish citizenship
In a judgment of February 22, 2018 (LEX No. 2462771 II OSK 1233/16), the Supreme Administrative Court stated that administrative bodies are not exempt from independent taking of evidence and cannot transfer its burden entirely to a party to the proceedings.
In the case under consideration, the General Court found, inter alia that an administrative body should, for example, independently search for civil status files.
